When immigration enforcement starts with the color of your skin, where does law enforcement end and racial profiling begin?
There is a question that America needs to ask itself, and it is not a comfortable one:
Can a person be stopped by federal immigration officers because he looks Latino?
The short legal answer is, not simply because he looks Latino.
But the longer answer is where things get complicated.
And increasingly, uncomfortable.
I support the rule of law. I believe a country has the right to control its borders, enforce its immigration laws and remove people who are here unlawfully when the legal process calls for it. If someone commits a serious crime, regardless of whether that person was born in Brooklyn, Bogotá or Bakersfield, law enforcement should do its job.
But there is a huge difference between enforcing immigration law and making someone’s ethnicity part of the reason they become a suspect.
That difference matters.
Because being Latino is not probable cause.
Speaking Spanish is not probable cause.
Working construction is not probable cause.
Washing cars is not probable cause.
Standing outside Home Depot looking for work is not probable cause.
And, apparently, neither is having the wrong shade of brown.
But here is another point that seems to get lost in this conversation: Latinos are not one economic class, one profession or one immigration story.
There are millions of Latinos who own businesses, employ other people, hold college and advanced degrees, work as doctors, lawyers, engineers, accountants, teachers, executives, scientists and financial professionals. They sit in corporate boardrooms, operate restaurants, own construction companies, run technology firms, practice medicine, teach in universities and build some of the very businesses that keep the American economy moving.
There are Latino entrepreneurs who employ hundreds of people and Latino professionals making six-figure salaries. There are Latino homeowners, investors, professors, CEOs, police officers, elected officials and members of the military. There are Latinos whose families have been in this country for generations, and others who became American citizens through the legal immigration process.
In other words, Latino does not mean undocumented, poor, uneducated or working in a blue-collar job.
Just as importantly, being undocumented does not automatically mean someone is a criminal or a threat to public safety.
That distinction matters because when appearance becomes a shortcut for suspicion, the net can become very wide.
The Latino man wearing a suit walking into his Manhattan office could be a U.S. citizen.
The Latina woman driving a Mercedes to her medical practice could be a U.S. citizen.
The Latino owner of a construction company could employ 50 people and have lived in America for 40 years.
The Latino college professor could have been born three blocks from the courthouse where an immigration hearing is taking place.
And the guy standing outside Home Depot looking for work could also be undocumented.

You cannot determine which one is which by looking at them.
That is the point.
Immigration status is a legal question, not a skin color.
Criminality is a question of conduct, not ethnicity.
And being Latino is certainly not a crime.
America is too diverse, and the Latino community is too large and too economically varied, to reduce millions of people to a stereotype based on what they look like or what job they happen to be doing at the moment.
So yes, enforce the law.
Pursue criminals.
Secure the border.
Follow the legal process.
But let’s not turn someone’s ethnicity into a shortcut for determining whether they belong.
Because the Latino standing next to you might be the construction worker.
He might also be the guy who owns the construction company.
So, can ICE legally stop someone for “looking Latino”?
Here is where the law gets interesting.
In September 2025, the U.S. Supreme Court intervened in a case involving immigration enforcement operations in Southern California, Noem v. Vasquez Perdomo. The Court allowed the government to continue the disputed enforcement operations while the litigation proceeded.
Justice Brett Kavanaugh, writing separately, made an important distinction. Immigration officers need reasonable suspicion to briefly stop someone and question them about immigration status. That suspicion must be based on the totality of the circumstances.
The Court did not say that looking Latino is enough.
Quite the opposite.
Kavanaugh specifically wrote that apparent ethnicity alone cannot furnish reasonable suspicion. But he also said apparent ethnicity can be a relevant factor when combined with other circumstances.
And that is the legal gray area.
Imagine an ICE agent sees a Latino man at a bus stop.
The man is speaking Spanish.
He works construction.
He happens to be in an area where immigration officers believe undocumented workers frequently gather.
Is any one of those things enough to stop him?
No.
Can officers consider several of those circumstances together when determining whether reasonable suspicion exists?
Under the Supreme Court’s 2025 ruling, potentially yes.
That distinction may sound like legal fine print.
For the person being stopped, it is anything but fine print.

The Constitution does not come with a “Latino exception”
The Fourth Amendment protects people from unreasonable searches and seizures.
Immigration enforcement does not erase that protection.
The Supreme Court’s immigration-stop precedent goes back decades. In United States v. Brignoni-Ponce, the Court ruled that Border Patrol could not stop motorists simply because they appeared to be of Mexican ancestry. The Court acknowledged that ethnic appearance could be a relevant consideration in some circumstances, but it could not, by itself, justify stopping Mexican-American motorists.
In other words, Uncle Sam cannot simply say, “You look Mexican, let’s see your papers.”
That is not how reasonable suspicion is supposed to work.
And that principle remains relevant today.

But what about what is happening on the streets?
This is where the debate becomes much more than a constitutional law lecture.
In 2025, immigration enforcement operations in Southern California generated lawsuits alleging that federal agents were stopping people based on broad characteristics including apparent race or ethnicity, speaking Spanish or accented English, working certain jobs and being present at particular locations.
The Supreme Court’s decision temporarily allowed the government to continue those operations while the legal dispute moved forward. Justice Sonia Sotomayor, joined by other justices in dissent, sharply criticized the alleged practice and described concerns about Latino citizens and others being stopped or detained. Her dissent is a judicial opinion, not a majority holding, so those allegations should be understood as part of the disputed litigation record rather than as findings of the Supreme Court majority.
Still, the allegations were serious enough to produce a major constitutional fight.
And the story did not end there.
In September 2026, a federal judge in Southern California issued a preliminary injunction restricting warrantless immigration arrests unless officers determine that the person is likely to escape. The judge also required greater documentation of the circumstances supporting an arrest.
The ruling is significant because it demonstrates that immigration enforcement authority is not unlimited simply because the federal government is enforcing immigration law.
The government has to follow the law while enforcing the law.
Funny how that works.
Even ICE’s own policy says race should not be the deciding factor
Here is another interesting piece of this story.
ICE’s civil immigration enforcement guidance says that a person’s race, religion, gender, sexual orientation, gender identity, national origin and political associations should not be factors in deciding whether to take enforcement action, while recognizing limited circumstances where such characteristics may be directly relevant to immigration status or benefits.
That is pretty straightforward.
Race is not supposed to be the ticket that gets you pulled over.
And DOJ has also historically maintained restrictions on racial profiling. Its federal law enforcement guidance has stated that race and ethnicity generally cannot be used in routine or spontaneous law enforcement decisions, with limited exceptions, including circumstances involving a specific suspect description or reliable information connecting a characteristic to a particular violation or threat.
So, no, there is no federal law that simply says:
“If someone looks Latino, ICE can stop him.”
There isn’t.
The actual legal standard is more complicated, requiring reasonable suspicion based on the circumstances.
And that distinction is precisely why the current debate is so important.
What happens when “looking Latino” becomes part of the formula?
This is the problem.
Latinos are not a uniform population.
A Latino can be Black.
A Latino can be white.
A Latino can be Asian.
A Latino can speak Spanish, English, Portuguese or neither.
A Latino can be a fourth-generation American whose family has lived in the United States longer than some immigration agents’ families.
A Latino can be a police officer.
A Latino can be a federal judge.
A Latino can be a U.S. senator.
A Latino can be undocumented.
A Latino can also be the guy who owns the construction company.
Or the guy who cleans the office after everyone else goes home.
Or the guy driving the truck delivering the food to the restaurant where everybody is eating lunch.
That is why using appearance as a shortcut is so dangerous.
Because appearance does not tell you immigration status.
The human-rights question
There is also a broader human-rights issue here.
The United States is a party to the International Covenant on Civil and Political Rights, which addresses equality before the law, discrimination and protection against arbitrary arrest or detention.
The United Nations Human Rights Committee has specifically expressed concern about racial profiling involving U.S. immigration agencies, including Customs and Border Protection and ICE, and has identified people of Hispanic and Latino origin among the groups affected.
The UN Committee on the Elimination of Racial Discrimination has likewise addressed racial profiling by law enforcement and called for stronger measures to prevent discriminatory enforcement.
There is an important legal distinction here, too.
A human-rights concern does not automatically mean that every immigration stop violates international law or U.S. law.
But when enforcement becomes based on racial or ethnic characteristics rather than individualized facts, it raises precisely the kinds of discrimination and arbitrary-detention concerns international human-rights standards are designed to address.
And then there is the Latino workforce
Let’s talk about something else Americans sometimes conveniently forget.
A significant portion of the American economy runs because somebody gets up before sunrise and goes to work.
Construction.
Agriculture.
Landscaping.
Restaurants.
Hospitality.
Cleaning.
Warehouses.
Food processing.
Home health care.
Delivery.
Roofing.
Painting.
You name it.
Many immigrants, including Latinos, work in these industries.
That does not mean every immigrant is undocumented.
It certainly does not mean every Latino worker is an immigrant.
And it absolutely does not mean every undocumented immigrant is a criminal in the traditional sense.
Immigration violations are generally civil matters, although an individual may also have committed criminal offenses.
That distinction gets lost in political arguments.
And when it gets lost, everybody starts becoming “the bad guy.”

I am all for going after criminals
Let me make my position clear.
If someone is here illegally and has committed murder, rape, trafficking, violent assault or another serious crime, I have no problem with law enforcement pursuing that person.
Do the investigation.
Find the person.
Arrest the person.
Give that person due process.
Let the courts do their job.
If deportation is legally warranted, carry it out.
That’s law enforcement.
But if the government walks into a parking lot and sees 20 Latino men and starts thinking, “Let’s check these guys because they look like they might be undocumented,” we have entered very different territory.
And if a U.S. citizen gets caught in that net simply because he happens to look Latino, the question becomes even more serious.
Because the government didn’t stop a criminal.
It stopped an American.
Why does this seem so heavily focused on Latinos?
There are legitimate demographic and enforcement explanations that should be considered before jumping to conclusions about motive.
First, the overwhelming majority of unauthorized immigrants in the United States historically have come from Latin America and Mexico, although the immigrant population is increasingly diverse.
Second, many immigration-enforcement operations are concentrated in industries and locations where Latino immigrants are disproportionately represented.
Third, language can become an enforcement factor because Spanish is widely spoken among immigrants from Latin America.
Those facts can help explain why Latino communities experience immigration enforcement so heavily.
But explaining something is not the same as justifying every method used to accomplish it.
That distinction is important.
Then comes the demographic question
There is another elephant in the room, and it is a very large elephant.
The United States is becoming dramatically more Latino.
According to Pew Research Center, the U.S. Hispanic population reached approximately 70.1 million in 2025, representing a major demographic transformation over the past several decades.
Census projections have also consistently shown substantial Hispanic population growth over the coming decades. A 2023 Census projection put the Hispanic share of the U.S. population at about 26.9% by 2060 under its middle immigration scenario.
Earlier Census projections were even higher, estimating nearly one-third of the country could be Hispanic by 2060.
So yes, America is changing.
But here is where we need to be careful.
There is no solid evidence establishing that the current expansion of immigration enforcement is being driven by fear of a future Latino majority.
That would be speculation.
There are certainly people who make that argument, and demographic change has enormous political, economic and cultural consequences.
But correlation is not proof of motive.
If we are going to expose something, we should expose facts, not manufacture them.
The demographic transformation is real.
The question of what political and cultural consequences it will have is real.
But claiming that ICE enforcement is secretly designed to prevent Latinos from becoming the majority would require evidence that has not been established.
And that’s where journalism needs to remain journalism.
America has been through this movie before
There is an uncomfortable history here.
Throughout American history, immigration enforcement and racial identity have occasionally collided.
Chinese immigrants were targeted by exclusion laws.
Japanese Americans were incarcerated during World War II.
Mexican Americans have experienced discrimination and mass-deportation campaigns.
Muslim and Arab communities experienced intense scrutiny after September 11.
History teaches us something important:
When government starts treating an ethnic group as a proxy for a security problem, innocent people eventually get caught in the net.
That does not mean immigration enforcement is inherently discriminatory.
It means enforcement must be individualized.
The person matters.
The evidence matters.
The facts matter.
The danger of turning ethnicity into evidence
Think about how absurd this sounds outside the immigration debate.
Imagine police saying:
“You look like someone who commits burglaries.”
Or:
“You speak Spanish, so we want to know what you’re doing here.”
Or:
“You work at a car wash, so we think you might be undocumented.”
None of those things tells us whether the individual committed a crime or violated immigration law.
They tell us what someone looks like.
That’s a very different thing.
America has spent decades telling itself that people should be judged by their actions.
We should probably keep that tradition alive.
Law enforcement deserves respect, but so does the law
There is another side that deserves recognition.
ICE officers are doing a difficult job.
Immigration enforcement can involve dangerous individuals, complicated cases and genuinely serious threats to public safety.
Federal agents have been assaulted and attacked while carrying out enforcement operations, and the government has reported increased threats against immigration officers.
Nobody should confuse criticism of immigration policy with hatred of law enforcement.
We can support officers doing their jobs and still demand that they follow constitutional rules.
Actually, that is what supporting law enforcement should mean.
The badge does not make someone above the law.
The badge represents the law.
The real question is simple
America does not need to choose between secure borders and civil rights.
It does not need to choose between enforcing immigration laws and protecting American citizens.
It does not need to choose between deporting people who legally qualify for removal and treating Latino Americans with dignity.
It should be able to do all of those things at the same time.
The test should be simple:
Show me the evidence.
Not the skin color.
Not the accent.
Not the neighborhood.
Not the job.
Not the assumption.
The evidence.
If ICE has information that someone is unlawfully present, follow the law.
If someone has committed a serious crime, investigate it and prosecute it.
If someone has a deportation order, follow the legal process.
But if the only thing you know about a person is that he looks Latino, speaks Spanish and is standing outside Home Depot waiting for work, that should not magically transform him into a suspect.
Because in America, citizenship should not come with a required skin tone.
And being Latino should not come with a permanent invitation to prove that you belong.
I believe in the rule of law.
But the rule of law has two words that are equally important.
Rule.
And law.
The government must follow both.
And when it doesn’t, somebody has to ask the uncomfortable question.
